I hope this man files a lawsuit against the police department and anyone else that was falsely arrested. It’s 2024 for heavens sake and you can do test on the spot by having them to blow into something. Stop the stupid test where the officer determines if someone can walk a straight line. As I said on another comment, I have hurt leg and back but I also have major cramps in my feet and I really don’t think I could pass a test. This is nonsense. This could ruin someone’s career.

Is anyone going to address the video that shows no evidence of him 'crashing into two patrol cars'? In fact, it seems we got just enough of the video as to not see if the patrol car tried to hit/pit just before the car started to swerve in traffic. This would mean the police put others in danger. We need more of this video. They seem to be stacking charges, and the news (as usual) is contradicting themselves in real time.

It shouldn't be surprising that he stumbled on his field sobriety test. Balance tests are really really hard to do in the dark when you don't have a well-lit environment providing visual cues to your brain. It's another reason not to submit to field sobriety tests, especially at night.

Unfortunately there's no legal recourse for this. Walmart is a private business they don't need anyone in. Yes, its sucks but its their store their rules and it's legal

This isn't just happening in Tennessee. I recently served jury duty in MA for a similar case where standard field sobriety tests were the basis of the arrest and the officer refused to give a breathalyzer test. The body cam footage showed a compliant man who remained remarkably calm throughout the incorrectly administered tests. Deliberations only took 3-minutes to find him not guilty. When I went home, I tried the sobriety tests and could not pass two of them. Granted, I'm an elderly man, but I don't drink. I run 4-1/2 miles/day, 5 days/week, so I don't think I have mobility issues. Maybe the standard field sobriety tests need to be reevaluated.
